MIAMI CARNIVAL COSTUME TERMS & CONDITIONS

By submitting a deposit and/or payment toward the purchase of a costume, the purchaser (“Masquerader”) acknowledges and agrees to the following Terms & Conditions:

1. Deposit & Refund Policy

All deposits and payments made toward a costume purchase are NON-REFUNDABLE and NON-TRANSFERABLE.

The Masquerader understands that deposits and payments are used to secure materials, labor, production costs, and other expenses associated with the creation of their costume. As a result, no refunds, chargebacks, cancellations, or credits will be issued under any circumstances, including but not limited to withdrawal from participation, inability to attend the event, travel issues, personal circumstances, or event-related changes.

2. Costume Sizing

The Masquerader is solely responsible for selecting the correct costume size at the time of registration or purchase.

The costume size selected during registration is the size that will be produced and distributed. Size changes, exchanges, or substitutions are not guaranteed and will not be accommodated once production has begun.

Any assistance with size changes will be solely at the discretion of the Section Leader or Band Management and is not guaranteed.

3. Costume Collection

The Masquerader is responsible for collecting their costume during the designated distribution period communicated by the Section Leader or Band.

Failure to collect a costume during the designated distribution period does not qualify the Masquerader for a refund, exchange, credit, or compensation.

4. Costume Design & Production

The Section Leader reserves the right to make reasonable modifications to costume designs, materials, trims, embellishments, colors, and accessories due to material availability, manufacturing requirements, or production limitations.

Such modifications shall not constitute grounds for cancellation, refund, or dispute.

5. Assumption of Risk

Participation in Miami Carnival and related events involves inherent risks, including but not limited to physical activity, travel, weather conditions, crowd-related incidents, accidents, injuries, illness, and property loss.

The Masquerader voluntarily assumes all risks associated with participating in Miami Carnival and related events.

6. Limitation of Responsibility

The responsibility of the Section Leader is limited solely to the design, production, and distribution of the costume purchased.

The Section Leader, Tori.X.Designs, its representatives, assistants, affiliates, and partners shall not be responsible or liable for any injury, illness, accident, loss, theft, damage to personal property, travel disruptions, event cancellations, or any other incident occurring before, during, or after Miami Carnival or any related event.

7. Chargebacks & Payment Disputes

By making a payment, the Masquerader agrees not to initiate a chargeback or payment dispute for any non-refundable deposit, installment, or final payment made under these Terms & Conditions.

Any attempt to reverse or dispute valid charges may result in cancellation of the costume order and may be subject to collection efforts and recovery of associated costs.

8. Acceptance of Terms

Submission of a deposit, installment payment, or full payment constitutes the Masquerader’s acknowledgment that they have read, understood, and agreed to these Terms & Conditions in their entirety.
